This Acceptable Use Policy governs your use of CarProximity's services and sets forth guidelines to ensure a safe, legal, and effective platform for all users.

1. General Principles

You agree to use CarProximity's Services only for lawful purposes and in accordance with:

  • All applicable federal, state, and local laws
  • These Acceptable Use Policy guidelines
  • Our Terms of Service and other policies
  • Industry standards and best practices

2. Permitted Uses

CarProximity's Services are designed for:

  • Automotive Marketing: Promoting dealerships, service centers, and related automotive businesses
  • Location-Based Advertising: Reaching customers based on geographic proximity
  • Business Promotion: Advertising vehicles, services, promotions, and events
  • Customer Engagement: Communicating with customers who have provided consent

3. Prohibited Activities

3.1 Illegal Activities

You may NOT use our Services to:

  • Engage in any illegal activity or promote illegal goods/services
  • Violate any laws, including TCPA, CAN-SPAM, or consumer protection laws
  • Infringe on intellectual property rights (trademarks, copyrights, patents)
  • Commit fraud, identity theft, or financial crimes
  • Facilitate money laundering or terrorist financing

3.2 Spam and Unsolicited Messages

  • Send spam or unsolicited marketing messages
  • Message recipients without proper consent
  • Use purchased or rented phone/email lists without verified consent
  • Fail to honor opt-out or unsubscribe requests
  • Send deceptive or misleading messages

3.3 Harmful or Offensive Content

  • Distribute malware, viruses, or harmful code
  • Send offensive, obscene, or sexually explicit content
  • Promote hate speech, discrimination, or violence
  • Harass, threaten, or abuse others
  • Bully or intimidate individuals or groups

3.4 Deceptive Practices

  • Make false or misleading claims in your campaigns
  • Misrepresent your identity or affiliation
  • Create fake accounts or impersonate others
  • Engage in phishing or social engineering attacks
  • Use bait-and-switch tactics or false advertising

3.5 System Abuse

  • Attempt to access unauthorized areas of the platform
  • Reverse engineer, decompile, or disassemble our software
  • Introduce viruses, worms, or malicious code
  • Overload or disrupt our servers or networks
  • Scrape, spider, or harvest data from our platform
  • Circumvent security measures or access controls

3.6 Prohibited Industries

Without prior written approval, you may NOT use our Services for:

  • Adult content or services
  • Gambling or online casinos
  • Pharmaceuticals or controlled substances
  • Multi-level marketing or pyramid schemes
  • Payday loans or predatory lending
  • Weapons or ammunition
  • Tobacco or vaping products

4. Campaign Content Standards

4.1 Truthful Advertising

All campaign content must be:

  • Truthful and not misleading
  • Backed by evidence when making claims
  • Clear about pricing, terms, and conditions
  • Compliant with FTC advertising guidelines

4.2 Required Disclosures

  • Include all material terms of offers
  • Clearly state pricing, including taxes and fees
  • Disclose financing terms and conditions
  • Include dealer/service center name and location

4.3 Intellectual Property

  • Only use content you own or have permission to use
  • Respect manufacturer trademarks and brand guidelines
  • Do not use copyrighted images without authorization
  • Obtain proper rights for music, videos, and other media

5. Data Protection and Privacy

5.1 Customer Data

  • Protect customer data with appropriate security measures
  • Only collect data necessary for your business purposes
  • Comply with privacy laws (GDPR, CCPA, etc.)
  • Maintain transparency about data collection and use

5.2 Consent Management

  • Obtain proper consent before messaging customers
  • Maintain accurate records of consent
  • Honor data subject rights (access, deletion, etc.)
  • Provide clear opt-out mechanisms

6. Account Security

  • Use strong, unique passwords for your account
  • Enable two-factor authentication when available
  • Do not share your account credentials
  • Report unauthorized access immediately
  • Regularly review account activity
  • Ensure only authorized personnel access your account

7. Reporting Violations

If you become aware of violations of this policy by another user, please report it to:

8. Enforcement

8.1 Investigation

CarProximity reserves the right to:

  • Investigate suspected violations of this policy
  • Access and review your account and campaign content
  • Cooperate with law enforcement investigations
  • Disclose information as required by law

8.2 Consequences of Violations

Violations may result in:

  • Warning: First-time minor violations may receive a warning
  • Campaign Suspension: Temporary pause of active campaigns
  • Feature Restrictions: Limitation of certain platform features
  • Account Suspension: Temporary suspension of account access
  • Account Termination: Permanent closure of your account
  • Legal Action: Pursuit of legal remedies for serious violations

8.3 No Refunds

Violations resulting in suspension or termination do not entitle you to refunds of fees paid.

9. Appeals Process

If your account is suspended or terminated for an alleged violation:

  • You will receive notice of the violation
  • You may appeal the decision within 30 days
  • Submit appeals to appeals@carproximity.com
  • Include your account information and explanation
  • We will review and respond within 15 business days

10. Changes to This Policy

We may update this Acceptable Use Policy at any time. Material changes will be communicated via email. Continued use of the Services after changes constitutes acceptance of the updated policy.
